Sell a House During Bankruptcy

Metroplex Homebuyers purchases Dallas-Fort Worth houses from owners who are in bankruptcy or considering it. A sale during bankruptcy needs approval from the trustee or the court, and we work around that approval on timing.

Does this sound familiar?

  • An open Chapter 7 or Chapter 13 case
  • Thinking about filing and unsure what happens to the house
  • Behind on the mortgage while in a payment plan
  • A Chapter 13 plan that has become hard to keep up
  • A trustee who wants the house sold
  • Equity in the house beyond what you can protect

Selling During a Chapter 7 Case

In Chapter 7, the trustee looks at whether the house has equity that creditors could reach. Texas protects a homestead generously, so many homeowners keep their equity, but a house that is not your homestead may be sold by the trustee.

Either way, a sale while the case is open goes through the trustee or the court. We work with the trustee, and with your attorney if you have one, so the sale is approved before closing.

Metroplex Homebuyers did a fantastic job at making my property selling experience much better than it could have been under very trying circumstances. Justin went well above and beyond in his services to me and helped me tremendously through the whole process and even after the sale. He was extremely helpful in all aspects of the process. I would highly recommend Metroplex Homebuyers to anyone considering selling their house. Thank you, Justin!

Selling During a Chapter 13 Plan

In Chapter 13, you keep your property and repay debts through a plan. Selling the house usually means asking the court for permission with a motion to sell.

A sale can pay off the mortgage, cover what the plan requires and leave you the rest. Some homeowners sell when the plan payments become too hard to keep up.

We can help with the move, and in some cases arrange a leaseback after closing, on terms the trustee or court approves.

Before You File

If you have not filed yet, selling first can change your options, and the timing is worth thinking through before you file. We are glad to give you a written offer to weigh, with whoever is advising you, before you decide.

How it works

The same simple process every seller gets, applied to your situation.

  1. 1

    Tell Us About the Case

Enter the property address or call us. Share the chapter, the case status and the trustee's name, plus your attorney's contact information if you have one.

  2. 2

    Review Your Written Offer

Your offer is usually ready within 24 hours, in writing, so the trustee, the court and anyone advising you can review it.

  3. 3

    Close After Approval

Once the trustee or court approves the sale, we close through a title company on the approved terms.

Common questions

Can I sell my house while in bankruptcy?

Usually, yes, with approval from the trustee or the court. We plan the closing date around that approval.

Do I keep the money from the sale?

It depends on the chapter, your exemptions and the court's order. The approved sale terms spell out where the proceeds go.

Does Texas protect my home in bankruptcy?

Texas has one of the most generous homestead protections in the country, but how it applies depends on your case and the exemptions you claim.

Can you buy the house if I am behind on the mortgage?

Yes. The mortgage is paid off at closing from the sale, as approved by the trustee or court.

Metroplex Homebuyers gave us the best price for the house we sold, and honored everything they said they would. In addition, their sales agreement was clear and straightforward. All the staff I dealt with were courteous, professional, and helpful, and the title company they work with was very much the same. Overall, this was a very good experience.

Response from Metroplex Homebuyers

Metroplex Homebuyers made selling my house an extremely easy and worry-free process! Josh came out quickly and made me a great offer on the spot! By the next day, Brandon had contacted me and was in touch with the title company to ensure that the closing went smoothly. Every time I had a question (and I had LOTS of questions) they answered promptly and thoroughly. They were friendly and appreciative of my business! The title company they work with was also wonderful. A notary even came to my house to make my life easier. The house was paid off and money was in my account the next day! I highly recommend this company to anyone that wants to sell their house quickly and for a great price.
